Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Mindful Menu mobile application (the "App"), operated by M-Holdings Group LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years of age to use the App. The App is not intended for children under 18, and we do not knowingly collect personal information from children under 18.

2. Account and Security

The App does not require an account or login. However, you are required to set a PIN to lock certain features (e.g., weekly meal plans). You are responsible for keeping your PIN confidential. We are not liable for any unauthorized access resulting from your failure to secure your PIN.

3. Use of the App

• You may use the App for personal, non-commercial purposes only.
• You agree not to misuse the App, including but not limited to: interfering with its operation, attempting to gain unauthorized access, introducing viruses or harmful code, or using the App in any way that violates applicable law.
• The App is provided "as is" without warranties of any kind, express or implied.

4. User Content and Data

All data you enter into the App (such as meal plans, custom tokens, settings, and PIN) is stored locally on your device. We do not collect, store, or have access to your data on our servers. You are solely responsible for the accuracy and appropriateness of any information you input.

We do not moderate, review, or endorse any user-entered content. You agree not to input any unlawful, harmful, or infringing material.

5. Intellectual Property

The App, including its design, text, graphics, logos, icons, software, and any associated trademarks, are owned by M-Holdings Group LLC or their respective owners and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal use only, subject to these Terms.

6. Third-Party Services and Links

The App may contain references to third-party services (e.g., restaurant brands, grocery stores) for informational purposes only. We do not endorse, sponsor, or have any affiliation with these third parties unless explicitly stated. Your interactions with third parties are solely between you and them.

7. Limitation of Liability

To the fullest extent permitted by law, M-Holdings Group LLC, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the App;
• Any unauthorized access to or use of your device or data;
• Any interruption, loss, or corruption of data stored locally on your device;
• Any reliance on information provided within the App.

In no event shall our total liability exceed the amount you paid to use the App.

8. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may stop using the App at any time by uninstalling it from your device.

9. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Orange County, Florida.
